I placed a bid on a house and got it under contract. The seller and listing agent posted that the house was renovated and had "New" carpet, flooring, paint, HVAC, Water heater and much more" I went to the house and to my dismay none of the items were new. Then my agent (who i thought should have been representing me) made it know that the house was rented and the tenant had moved out of the house recently. I feel cheated because I feel like I over paid for the property. I paid for a turn key property with new interior and now I am getting one with filthy carpet, damaged floors, peeling paint, rooted wood, and a house that is showing atleast 1 yr worth of wear and tear.

I told my agent that I was not satisfied with it and that it was misrepresented. However instead of representing me they ran off and told the seller about my conversation with them and make it appear as if I am the one trying to make a big deal out of nothing. I feel cheated yet again.... Isn't my agent suppose to be on my side? They are making it seem like i'm going crazy... when they lied in the MLS ad with the description and the pictures of the house and i'm the one going crazy.

I need help.... I'm not being represented by my agent, I can't even confide in them because i'm afraid that she's going to run right back to the seller with anything I say. Oh best... part my agent is speaking to the seller on a daily basis now, even though I have not been sending any correspondences his way. No this isn't a dual agency situation, he has his own agent, and I'm suppose to have mine. What should I do? I'm thinking about seeking legal advice.

You purchased a property without seeing the property or interior and are looking for who to blame.

Avakay64 would be a good place to start.

The contract is typically pending the inspection. What happened to that step?

"I'm not being represented by my agent" Unless you have a buyers agent, 'your' agent works for the seller. The seller is the one who is paying them.


But as few others have asked, You didnt go inside, You didn;t have a inspection requiremnet in the contract?

What happened to the walk through the night before the closing? Why weren't you present at the home inspection? Most of us are having a hard time picturing exactly how you could buy a property of which you didn't know the condition before you went to the closing.

Who cares if he didnt see the house? Its still dishonest just to make a buck. So they should be held accountable. I would be pissed too.

Can you get your money back? If not, take them to court. Take pictures of the house, compare them to what was advertised. Don't let them get away with this

Are you on an online auction? Does the MLS say "AS-IS"? Do you have due-diligence or financial contingency?
If it is a human we are talking, talk to the seller directly (Agents have vested interest so more in your case). You may be able to convince the seller. Going into a law-suit is bad for all parties, so hope seller will realize the mistake and take you off hook

Even when you purchase a home as-is, you still have a due diligence period pending inspection.

Simply back out of the deal and get a new agent. If you feel like you want to, seek your earnest money back in a small claims magistrate court.

I don't think this post is real. Nobody is dumb enough to put a house under contract without even seeing it. Dirty carpet is the best thing that can go wrong in that situation.
