I used to live in one of the HOA's mentioned in the story. After the developer pulled out, I started noticing lack of open record keeping, secret meetings & closed door decisions about how the HOA dues were being spent. The Board was openly breaking a lot of the by-laws, with the justification that it was their right as the HOA Board.

My efforts to get involved were met with citations for false HOA violation citations. What was even more frustrating was that we had no rights to defend ourselves against these made up charges. Our options were to get involved in a lawsuit with the Board or sell our house at a loss and move. We are very happy now in our non-HOA neighborhood.

Texas needs major HOA reform. Currently there are no checks & balances if you end up with a rogue Board other than getting involved in a lawsuit with them. I think eliminating the HOA Board's power to blacklist homeowners and to privately fine homeowners would go a long way. Currently the Board holds the power to not only make the laws, but also to be the police, judge, jury & an executioner.
