thing is w/ a yard is that plenty of lazy owners will just open the back door and leave the dog out there alone. this is undesirable for many reasons:

-puts the dog at risk for theft
-can create a noise nuisance for neighbors
-the dog can get in hurt when not supervised
-over time, the dog can become very territorial about the yard. this could possibly cause an issue whee the dog attacks anyone stepping into the yard, aka its territory. hence why "junkyard" dogs and dogs left tied up outside are so dangerous.
-there's no guarantee the dog will adequately exercise itself in the yard, meaning, once it comes back inside, it can still be overly energetic and destructive.
-the dog gets little interaction w/ the owner. most people w/ yards aren't out there for an hour at a time playing fetch w/ the dog. they just leave the pup out there to amuse itself.

without the yard, owners must actually *gasp* go out with their dog and at least hold the other end of the leash. an owner you talks their dog out for walks, takes them to dog parks, jogs w/ them, etc, is interacting more w/ their pet than those owners w/ yards that just leave the dog out there

as for your concerns

-there are such things as dog booties. they've been around for quite some time. there's also pet safe salt that some people use outside their own buildings/homes
-people not picking up after their dogs has little to do w/ your assertion that keeping a dog in an apartment w/o a yard is "torture". people not following the ordinance has NOTHING to do w/ whether one should own a dog if they don't have a yard. dogs are going to be in public places-deal w/ it.

I don't have to. Any bar or restaurant that allows dogs will not get my business. There are plenty of people that are fed up with this crap. ( pun intended )

Slightly off topic but this thread reminds me of the bodybuilding neighbor I had at my old Loop highrise who often got stuck having to walk his girlfriends teeny tiny fluffy dog. He rarely looked happy about it!

I would consider new eastside. If you go with one of the cheaper building like the Shoreham you can probably get a 1 bedroom for 1500ish (after a month free for a new lease). They allow dogs in most of the buildings in the neighborhood and you're on a decent sized park, including a dog run.
