my subdivision started a home owners association my deed has nothing about this do i have to pay the fee or join this nightmare

Get a good Real Estate Attorney. Jamie Zitesman in Dublin is great.

By the way what neighborhood do you live in? It is rare for an after the fact HOA to be started.

If you already owned your home before they decided to start an HOA, then I don't think there's any way they can force you to join. You can opt out or be "grandfathered" out if you choose.

Nonetheless, I second Mez's advice: find a good real estate attorney to counsel you.

Besides, I totally agree with your feelings about HOAs in general. I hate these organizations!

HOAs are just a way for nosy, busybody neighborhood nazis to take away your freedom and intrude in your personal life. Screw that!

How do you start a mandatory HOA not established at the time of the deed?

It seems like it would be a voluntary organization to me.

This sounds like a voluntary organization most likly a civic association. You would not have to join it. My old neighborhood just started one to try to get the city to help clean up some of the run down houses and yards ie. junk cars parked in the front yard. It may give your neighbor hood more clout to get roads repaired ect. So maybe not a bad idea since they will not have the same power as the home owners association that is in my deed of my new house.

I'd think since it wasn't in your deed you aren't obligated to join. Still, I'm no attorney.

Our neighborhood (still being developed) didn't have an HOA at first. The builder did everything. It was instated later (city council forced him if he wanted to build any more homes). But I think it was inevitable as it was probably in the housing deeds. Just wanted to point out that it could be started after the fact.

While I think some HOA's go overboard, many arrange benefits or work with the city to bring in playground equipment for a park, or host community parties. I wish ours would actually enforce the rules regarding privacy fences. Yeah, some look wonderful, but most are poor to begin with, become a mess, and detract from an open community. Those are the things that detract from neighboring property values.
