I'm not sure how i feel. I wouldn't want to be impaneled for a trial for this case.

I think it is ridiculous that he only got charged with a misdemeanor. This was murder, plain and simple. He should be sent away for life.

Murder has to show intent. He clearly did not intend to do this.

Thank God my kid is a healthy 5 year old. But when he was a baby, I remember once or twice, I would be at work, and my heart would sink because for a fraction for a second I couldn't remember if took the baby out of the car and into day care--of course I did...but just for that short instant I would panic. I think this is only an irrational fear a parent could have. But, unless there are other facts showing that this guy meant to hurt his baby, I think it was just a horrible accident.

I would say the act itself shows intent. Any explanations of simply forgetting seem implausible.

By that logic, anyone who is at fault for a car accident where their passenger or other party is killed should be charged with murder? Yeesh. Thankfully our justice system is more logical than that.

An unusual strong dissent from me on this one... I have three kids and have never once even for a fraction of a second forgot any or all were still in the car. There are no distractions from the importance of family even for a single second when you are responsible for their well being or transportation. A busy schedule is no excuse.
