SMH at an comment like this. Democrats have demanded and received billions for Amtrak over the past 40+ years. It was supposed to have been self-funding after the initial pump-priming from the US taxpayer. That was the sales pitch. 45 years later Amtrak is still heavily subsidized by taxpayers.

Lawyer is ethically not allowed to advise the client to lie. Though the engineer could have asked, "What happens if I cannot remember anything?"

Engineer is doing the right thing and I'm sure Amtrak wants him to stay quiet also.

Things said can be misconstrued and end up in jail time.

Trauma and head injury can prevent you from remembering events, so I don't have a problem with his statement. The fact that he has a lawyer? This is a good thing; he's going to need to defend himself in some way, and it's better to have a legal expert than to try to wade through yourself - especially after a head injury.

My guess?

He was either:

1) Texting/distracted otherwise;

2) Sleeping; or

3) Speeding, going at the regular speed he normally does at that turn (note, while the train was going at more than twice the speed limit for that curve, and one takes a huge risk by doing so, it wouldn't shock me if he was able to get away with it multiple times before and thought that he now "knew better").

Some say that the train could have malfunctioned, but if the evidence supported that, I think that the engineer would be playing that point up right now. Instead, he's refusing to speak to the investigators and has lawyered up.

Now, based on the "no memory" line, I think that the engineer is going to try to push the "I passed/blacked out" narrative, but cell phone records could go a long way to proving/disproving that narrative.

I think authorities have already his cell phone records...if he was using that phone at time of crash whether he remembers or not...he is in big trouble...just not sure why he wasn't taken into custody immediately...if I was driving a car that was going twice the speed limit and killed six people and injured many more...wouldn't I have been given a sobriety test or taken into custody??? I could really refuse to co-operate? Just leave??

I think its what is expected ;not sure if truth or not. Seems a lot of these crash when speeding is involve. Last two I believe were in Europe.

I think the memory thing could be plausible. If you've ever been in an accident or witnessed something traumatic, sometimes your brain just won't allow you to accept or process it. The truth will come out one way or another.
