i didn't read the story until now. i see that she didn't actually molest him, yet. but she was fixing to! this was a case of catching a predator before they had the chance to molest. good thing they caught her and glad the boy didn't get molested.

I'd like to introduce a new train of thought--I have worked with special needs children for years and I am unaware of teaching assistants working with any other kind of student except special needs. In other words, was the boy special ed? That would impact the seriousness of the crime as well.

Some folks need to get acquainted with what the law states and not what others opinions say it should be. A 17 year old male was sentenced to the boys prison in Pendleton because he was caught having sex with a 12 year old who had hips and breast, and she consented. When he turned eighteen he finished the rest of his time in the Industrial Facility in Pendleton. I was surprised that he was dealt this kind of punishment knowing that he was underage himself. but after reading what the Indiana State law says about this matter I realized that the judge was doing his job. Because there was more than three years between the young man and the girl he had intercourse with he was guilty of a serious sex crime.

If we are truly concerned about children and say nail the teacher to the wall for going after an 11 year old, then shouldn't we say the same when a prosecutor says he wants to try one of similar age as an adult?

If indeed an 11 year old is a child, then they are always a child, without exception, whether they are the victim or the offender, yes?

The point is that in these matters, we like to go both ways, for whatever suits TPTB advantage. At best, it says we are hypocrites.

And at worse? Well, probably that TPTB will rewrite the rule book each time so to best serve them in controlling the populace.
Well, no, because sometimes the minor child is the offender and sometimes the minor child is the victim.

Not all under 18 year olds are the same.

And the punishment depends on the crime and the victim of the crime.

Regardless of the above, I have a hard time imagining any scenario where an 11 year old is not considered a CHILD.

It doesn't matter if she had "hips and breasts" she is still 12 years old.

17 year olds shouldn't be in relationships--sexual or not--with 12 year olds. Generally, 7th graders and 11th graders don't have that much in common.

The only exceptions I can see are the cases where the younger party lies to portray themselves as older.

I agree with what you are saying. I was just pointing out what the State of Indiana has to say about minors having intercourse with minors who are more than three years their Junior. Believe it or not a lot of folks would ague that that is a lot of B.S., and of course they have their opinions about the victims. But those are their opinions and the Law is the Law.
