The restaurant's lack of response in this case is troubling.

Some have commented on language barrier as a possible factor.

He should have had his epipen, but still, not to blame the poor guy completely.

Sad story but if I'm allergic that bad where I'd die or become comatose if I ate seafood, I'd probably eat at home or places that don't even serve seafood and ALWAYS carry my epipen.

agreed! while this is incredibly sad and scary i am not leaving my well being up to people working in a restaurant where mistakes can happen.

But that doesn't make this restaurant any less negligent in this instance.

This makes me think of the commercial currently running on television where the girl at the party goes into anaphylactic shock because the hostess forgot and put peanut butter in the brownies (OMG, it's on right NOW!, lol). I honestly can't believe that anyone who has any allergies would knowingly go out into any setting involving food or drink without their Epi-Pen. It's simply unthinkable. A person with that type of life-threatening condition cannot depend on others' knowledge or awareness of their own health problems to save their lives; it's in their OWN hands. While the waiter has some responsibility, I don't believe he should have been arrested. I've worked in restaurants and with the sound levels it is FAR too easy to not hear or mis-hear a customer's order and/or instructions. You can't leave your life in someone else's hands, period.

Even if the waiter had completely done his job, that still wouldn't have stopped the possibility of exposure to fish. If somebody is this severely allergic, they should stay home or go to restaurants that 100% do not serve seafood (like a burger or pizza place). Arresting the waiter seems a little ridiculous.

I feel like there is this weird trend towards making other people responsible for food allergies. At my kid's school they give you a long list of foods you shouldn't bring in for parties because kids are allergic. Essentially once the list is done...you can bring in water. But it better be kosher.

When I was a kid, kids with allergies would often have treats they could have stashed in the classroom so when people brought things they couldn't have, they still have a treat.

I mean I don't want this guy to get sick and die, but he needs to be ultimately the one in charge. His allergy is quite severe. He should, at minimum, have his epic-pen WITH him. He should ask the waiter to explain the dish when it is delivered to the table. He needed to ask to talk to the chef to explain his allergy, not the 22 year old waiter (that is standard, if you have a significant allergy, you ask to talk to the chef). Maybe he should take up cooking and eat at home...I mean, that is what I would do!!

Unless they can prove the waiter did it for kicks and giggles, I would not support him facing charges. My guess is he is a family member of the owner of the restaurant.

Or Canuel can learn to tell the difference between the smell of salmon and the smell of meat before you chomp down on anything. Or ask the boyfriend, "Taste this, please."

"The server almost killed me,' Canuel told the Globe and Mail. 'I know it was an error, but that error had almost taken my life.' "

He is the one with the allergy, but he seems to be taking no responsibility for leaving his epi-pen in the car. Doesn't the jerk know to always, always, always check to see that it is on you. Yeah, bad server, but bad guy who doesn't have his pen on him too.

One hopes M. Canuel has learned to appreciate the magnitude of his own error as well. He almost killed himself.

Of course the waiter has to be blamed/charged for what happened. Otherwise the 'victim' would have to take some responsibility for his own condition and lack of preparedness. Can't have that, now can we.
The waiter made a mistake, and the restaurant should go the extra mile to make amends to the customer. But charging the waiter with a crime seems a bit much to me.

Exclamation wait...

This patron...who is deathly allergic to seafood couldn't tell beef from salmon???? come on... all he had to do was smell it or stick a fork in it...his fault...very sad for this waiter.
