Has it been that long since elementary school? We missed seats when sitting down, fell out of seats, tipped chairs back too far, and our friends pulled chairs out from under us. I don't think the school was necessarily at fault, but I do think the kid was probably being a kid.
I doubt the school would lose in a court of law for negligence, but I think a custodian sitting up tables ought to check out the equipment.
As a school principal who sometimes supervised the cafeteria, I can see it happening. Our tables had 12 seats all together...not chair type seats, just stool type seats. I can see hurrying to an assigned cafeteria seat hoping to chat with friends and not noticing.

Looks like a serious law suit. At least she will have the money to pay for the college of her choice. That's what i WOULD DEMAND. Free college up to a PHD, plus all medical expenses, of course.
My kid used to fall down sometimes while carrying the lunch tray. She could look where she was going or she could watch her tray but she couldn't do both at the same time. It could have been the same sort of thing with this child not looking for the seat.
I went to a Catholic middle school and we went to Mass once a week. The boys sat in the pew behind the pew that the girls were in. The pews all had short pencils (in case someone forgot to fill out their donation envelope, I guess). The boys would wedge the pencils between the two halves of the cushion, so that the point was sticking up at an angle. If you sat without looking, you'd get poked by the pencils. I always looked before I sat (I had a really spiteful younger sister who would put glue or thumbtacks on my chair at home) but some of the girls didn't, and they'd spend the rest of the day with a bloody spot on the back of the uniform skirt. I assume no one was badly hurt by it or we probably would have heard something.
Ya I suppose so.......... This should not have happend (If things were maintained better)
