I don't know whether to blame management or the tenants.

Management should have made certain the apartments were vacated before removing the stairs.

The tenants apparently did not want to be out the cash for hotel rooms. Getting "rent credit" is not the same as having a room paid-for.

This part almost makes me wonder if they were trying to get rid of some slow or no-payers: "You can have the option of being released from your lease without any penalty"

The tenants of this building were given warning. They should have vacated. The property management should have made sure that the apartments were empty before beginning the job. Both parties are to blame.

I agree. It stated there were notices on the doors, and the original stairway was unstable and damaged. Management could have simply gone door to door early before the work started. Easy.

I'd be inclined to believe the management over the tenants in this case, just based on the tone of the letter that at least one of them actually got (and apparently ignored). From my reading of the article, the stairs were unsafe, so pulling them down asap was proper & anyone who left should have done it via a ladder. If the staircase was unsafe, letting people use it even once wouldn't be dangerous- especially if they were trying to carry all their stuff out.

How do we know they didn't go door to door? Some residents claimed "no notice", but then there were notices tacked on every door & in mailboxes..

Tenants are mainly at fault here in my opinion. They probably tossed the notices in the trash.

I would side with the landlord over this. When I worked in property management we would notify everyone of a pending job and in most cases tell that in person to the tenants what was going to take place over the next day or week at their property. We almost always had people that were upset that a truck and handyman showed up when we told them he would to fix a problem they were having.


Some people you just can't reach.

I am with the residents.

A) You cant expect them to turn their lives upside down because the land lords have been to cheep and lazy to maintain the stair case all along.

B) If I heard the stair case was being removed I would anticipate a new one would be up in a matter of a few hours...because that is reasonable and that is how long it takes

c) I would anticipate a second way out

D) the management should have gone door to door and made absolutely sure to talk to the head of each household to make things very clear.

But I grew up in crappy apartment complexes so I know exactly how they play their game. It wouldn't surprise me if they are trying to annoy the heck out of the tenants so they can turn them into "condos"

I see your points, but if you got a letter like that in the mail, wouldn't you go straight to management (or call, if that's the case) and ask? Um, excuse me, the staircase is being removed next week? Can you tell me how long it will be taken down? How many days should we expect to be vacated to a hotel over a single outdoor one story staircase?

It appears every single resident basically ignored the letter.

But yes, the management should have gone door to door an hour before the staircase was to be removed.
