The dad repeatedly told his son to stop texting at a Cape Cod restaurant. Outside, the son punched his father, who was knocked unconscious when he struck his head on the pavement.
"Felony assault and battery on a person over 60". There are different laws and penalties for assault on people under 60, and over 60? That's a new one to me.

I've heard of that before.
Apparently, it's meant to address elderly victims, but I don't agree with the distinction. A victim is a victim.

We have something similar in Colorado relating to any adult over the age of 70 & disabled adults over 18. Those are are considered a protected class called “At-Risk Adults”.
In the case of assault, it changes any charge of 1st, 2nd or 3rd degree Assault to a Felony. It is also used within the scope of Adult Protective Services, in the case of elder/disabled abuse & neglect.

Well, someone was gonna get arrested, because if Dad ColdCocked the kid - like he should have - then Dad gets arrested for abusing the poor little tyke.

It depends on the state.
I speculate it is because you could hit or punch an adult, for example a 30 or 40 year old, and A. they probably can protect themselves better and B. they probably will not get as injured than if you hit or punch, for example a 75 or 85 year old.

I hope that dad is OK. Head injuries like that can be very serious and even fatal.
If I was the father of that kid, I'd throw him out of the house.
Unless I am very much mistaken, as the boy is a minor, that is not legally permitted unless someone else accepts custody. That being said, I would first have the kid psychologically evaluated -- and then I might consider turning him over to Social Services.
In any case, I think the kid definitely has some anger management issues at the very least.

Sometimes you have to work backwards from the end of the story.
He was released on $40 bond to his mother pretty quickly.
My guess is, the father isn't blameless and the boy didn't intend to inflict such damage.
Or at least it appears mom isn't afraid of him.
