Yesterday driving in very heavy stop and go traffic on highway at 10 miles per hour I rear ended someone who stopped suddenly. No airbags were deployed. He only had a a 6 inch scratch line on his bumper. He refused to share information. The police came and he said he was hurt but he was walking around. The officer saw that but had to call ambulance. After his checkup he refused to go to the hospital. You could clearly see that he was falking. I was issued a failure to control speed ticket. What to do?

Failure to control the speed ticket just means that you hit someone. It's not a huge deal. Just pay the ticket or do defensive driving.

The previous reply is correct. Failure to control speed means you hit something because of your speed. It does not mean that you were driving at very high speeds or caused major damage or injuries. This is the wording of the law:

"An operator:... shall control the speed of the vehicle as necessary to avoid colliding with another person or vehicle that is on or entering the highway..."

Unlike a speeding ticket, this is based on the outcome. Basically, if you hit another vehicle because it stopped suddenly, then you're guilty of not doing what's required. The advice given above is correct. I hope this explanation clarifies what exactly the ticket means.

Tell your insurance company NOW. They have 24 hr. operators for accidents. Based on what you wrote, you may be facing a claim for injury.

He was right to have an ambulance show. My in-law was hit and thought she was "alright" after getting t-boned. The symptoms were delayed but because she didn't request an ambulance she had no leg to stand on to try to get the man's insurance to cover it. Cost them thousands in medical bills.

Get deferred adjudication or defensive driving to resolve your ticket. Report the accident to your insurance company. Let them deal with the allegedly injured individual and cooperate with your carrier in any way they request. Done.
