Walmart is completely responsible? I am sure there are about a dozen lawyers who are happy to hear that people buy that claptrap.
There is nothing inherent in the act of shopping that could have possibly caused this calamity. There is no reason to believe that reasonable adult people would act like an unruly mob under these circumstances. You can't control them outside if someone decides to rip the doors off the hinges and just run inside.
The shoppers who did this are the ones responsible.
Now are you going to go to India and sue the hotels where the terrorists killed the hostages, too?
To a point. The shoppers who trampled the poor guy bear the most responsibility, but by past experience, walmart knows what things are like on black friday sales, that it's dangerous, it would have been wise to have better security (perhaps armed to discourage troublemakers) to control the crowds. They'll be found liable to some degree for those reasons.
On the news, the police said it would be impossible to identify the individuals that caused this, so it looks like the shoppers won't be prosecuted. Walmart can definitely be sued, but it sounds like the shoppers actually broken the door down before the store opened--that doesn't sound like Walmart's fault.
Another thing--the one killed was a temp, not a perm. walmart employee. I don't know how that plays into this--if the temp agency could be liable as well. Walmart probably made sure to protect themselves in any agreement they had with the temp agency.

They probably should be sued. There were crowd control measures they could have taken--from past events they would know it's dangerous to let a huge group of people in at one time like that. Remember, somebody died because of this--this isn't someone spilling hot coffee on themselves and suing McDonald's.
1. They didn't let those people in. They broke in.
2. How sad is it that we have to control grown adults like so many senseless stampeding elephants?
How about grown adults act like they're supposed to?
Let's face it...There are many mindless people in the world.
I'm sorry to say, that even in our modern society, there are people that lack the ability to think for themselves. And, they are easily influenced by what others do or say...
It's certainly not a matter of their race. Even though this particular incident may have more colored faces, there are plenty of similar incidences involving all skin colors...Soccer games in England, college Spring-break weeks, etc. etc...
Walmart offers good prices, that is helpful to many people (especially those down in their luck). We may all knock it, but almost all of us end up shopping there, some time or another.
These people got caught up in their own frenzy...It's not the stores fault. There are plenty of stores, in plenty of locations, offering the same deals. And the people act responsibly.
It's unfortunate...Now the money scavengers will cause another change in all of our lives, because it's always someone else's fault.
Everyone there had a choice to walk away when they saw the crowd forming, and fired-up...They simply had to use basic common sense...
The doors probably could have been secured better. Unfortunately people tend to behave differently when they're part of a mob. That's human nature.

Wouldn't it be wonderful and in the spirit of Thanksgiving and Christmas to have fully armored security guards with rubber bullet weapons, firehoses and tear-guns to usher the holiday spirit as the crowd pushes in? They could also all dress up as Santa Clauses! Those Currier & Ives greeting cards are so outdated. This sight will be a much better greeting card. I think I will write Walmart management with this suggestion! They are sooooo inept with their security measures!
