No, it isn't comical. And it most certainly would stand up to scrutiny. What about ILLEGAL presence in a country do you not understand? One DOES NOT have a permanent domicile and/or residence in a country which one shouldn't even be in at all. When one can be deported for illegal presence in a country, one does not have a permanent domicile or residence in that country. Pretty straighforward.
Of the illegal immigrants who have lived in the U.S. for a decade or more, 45% own their homes. Good luck convincing a local judge, much less the Supreme Court, that the US isn't their permanent residence.

I know during the housing bubble, lots of illegals got liar loans to buy homes. However, when the bubble burst, the vast majority went into foreclosure. And since they were here illegally, many of them did a disappearing act never to be found again.
Then there are the illegals who engage in ID theft and buy a home, thus leaving the ID theft victim in a world of hurt.
Any illegals who own homes here need to lose those homes as they have no business being here. Period.

Although the law stopped short of enacting some of the most draconian penalties sought by the government, it has provoked widespread criticism from human rights groups. If they file taxes with the IRS they receive an individual taxpayer identification number. No citizenship or SS number is required. The IRS number allows them to apply for a home loan. Most dislike being renters and want to own their own homes so they can build equity. Like everyone else.
There are people Trump says he would deport living in homes worth hundreds of thousands of dollars in places like CA. They work hard, pay taxes, including hefty property taxes, and their mortgages and have a piece of the American dream: home ownership. If he doesn't know that....he's not as smart as he says he is.
