A Florida court threw out a lawsuit Wed. challenging the Democratic Party's decision not to seat delegates from Florida.
Judge Richard Lazarra sided with the party, saying political parties have the right to make their own rules.
This is the second Florida lawsuit protesting the Democratic Party's decision to be thrown out of court. An earlier one filed by Sen. Bill Nelson was also dismissed. Now there are rumors of an appeal to the Supreme Court, where I'm sure the lawsuit would meet the same fate.
That's unfortunate. I'm all for letting parties determine their own course and set their own rules, but I draw the line where their actions interfere with a fundamental state function and the very foundation of the democratic process. That deserves the strictest of strict scrutiny.

Both Fla. and Mi. refused to abide by party rules, they must be sanctioned.

This is not an election. this is a nomination process. I do not understand why this is not processed more by the news. We are nominating a Democratic candidate for election.

That all sounds real noble and such, but Michigan's governor Jennifer Granholm actually signed the DNC rule into state law.

Fundamental state function indeed.
Just like Charlie Crist did in Florida. Both of these states had items go through their legislatures and pass a vote. They knew they were breaking their party rules and they did nothing. These are your state congressional members. Because you weren't paying attention, Florida and Michigan, your elected officials screwed you over. Now that you realize, you want a do-over. Too bad.

I just love it. On Election night 2000, without any preconceived outcome, the rules of Florida counted GW Bush as having most of the votes. Any second count became questionable because of the tainting such a count would obviously incur. Now, before the game started, Florida said, we don't care, we'll vote early. So did Michigan.... Now that those votes count, politics enters the game.... You who are Democrat need to recognize that politicians never will determine the definition of "is".

It is both an election (a series of them, more accurately) and a nominating process. That's why it's called primary elections and must abide by the election laws and is overseen by election judges and certified by boards of elections and all that good stuff.
