"but we have to remember we are a nation of Laws."

So was Nazi Germany, Stalinist Russia, Maoist China, the Tali ban's Afghanistan and Hussein's Iraq, just to name a few. What's yer point Perry Mason?

You don't understand.

The lawyers crying foul are the former prosecutors from the military tribunals, including the Chief Prosecutor!

I don't know what Perry's point was, but mine would be that we are violating our own laws.

This hurts both our country and our goal to promote democracy around the world. It makes us look like the countries you named, instead of different.

What's your point?

Some detainees likely would be returned to the countries where they were first captured for further detention or rehabilitation. The rest could probably be prosecuted in U.S. criminal courts, one adviser said. All spoke on condition of anonymity to discuss the ongoing talks, which have been private.

Whatever form it takes, Tribe said he expects Obama to move quickly.

"In reality and symbolically, the idea that we have people in legal black holes is an extremely serious black mark," Tribe said. "It has to be dealt with."

I have no idea what the answer is, but this mess is one of many that The Bush Crime Family have left behind for someone else to clean up. Maybe Bush can set up a facility on the large parcel of land that he recently purchased.

BUSH REPORTED TO HAVE PURCHASED 99,000 ACRES IN PARAGUAY

"Why might the president and his family need a 98,840-acre ranch in Paraguay protected by a semi-secret U.S. military base manned by American troops who have been exempted from war-crimes prosecution by the Paraguayan government?"

Biden is an condescending and hypocritical moron and doesn't see eye-to-eye with President-Elect on a variety of issues, which coincidentally hasn't changed Obama's view on said issues. As one example, Network Neutrality. Pour that in yer jug and drink it hick.

What a weak argument... many, many, many, many, many huh? What does that add up to exactly? Not even a single link, citation, or single statistic. You're too sad... and your brush is certainly the broadest (and damaged)...Ready for some actual facts?

Shayana Kadidal, senior managing attorney for the Guantanamo Global Justice Initiative at the Center for Constitutional Rights:

"The military has already said they will only charge a maximum of 80 detainees at Guantanamo which leaves over 200 that will never be charged, and if you add that to the 500 that have already been released then it shows you the vast majority of these people there were picked up by mistake. "

"...it's worth pointing out that only 4% of detainees at Guantanamo were picked up on anything resembling a battle field. And only 1 out of 512 there in 2004 were picked up by the U.S. on a battlefield"

"... 780 have been held over the last 6 years at Guantanamo; over 500 have been released to their home countries, and you can count on the fingers of your hand how many have been charged, so that leaves 280; 80 of which the U.S. Military states they will charge, which previous evidence would indicate is a gross exaggeration. They've charged less than 20 so far and they seem to be willing to charge the lowest level offense, things such as participating in the Armed Forces of Afghanistan..."

John Hutson, adviser to Sen. Barack Obama's presidential campaign; president and dean, Franklin Pierce Law Center; former judge advocate general for the U.S. Navy

"...if it turns out that there is no evidence against these people indicating that they should be incarcerated or that there detention should be continued, well then their detention should not be continued... that's the whole point of Habeas Corpus"

"we have gotten ourselves in a real predicament with these people and a number of people that may not have been serious threats before...uh, as it remarked earlier in the conversation that many of those were turned over to us for revenge purposes or identified as terrorists when in fact they were not, but now... some 5-6 years later, they may be a problem, but one way or another, whether with refugee status or returning them to their home country, or to a 3rd country... or prosecuting them, that's the best answer. But among these alternatives. we need to do something because we simply can't hold them forever..."

Also worth noting:

Col. Stuart Herrington, (a retired interogator) was interviewed on June 16th, 2008 on the DH show, and reflected on how abysmal the conditions were on his last visit to inspect Get-mo. This man has oodles of experience in interrogation, from Vietnam to Panama, to Op. Desert Storm and interestingly enough, he stated the best information he was ever able to extort from a detainee was info as a result of the treatment given to detainees; rather than brutalizing the suspects and putting them in retrofitted shipping containers as cells (as was the case previously in Getmo), they gave them 4 star service (treated them with precedence according to rank; decent living conditions, good food etc.). Ironically, the men were much more apt to talk and share valuable intel; according to the Colonel.

This is would be the first time in US history that people captured on the battlefield in foreign land would be subject to US civil courts and laws. In wars past such people were tried by military court. And to the bleeding heart liberals crying about torture, my next post will be a link to a CNN story on what real torture is all about and this torture was performed against American soldiers you seem to hate so much.
