This is would be the first time in US history that people captured on the battlefield in foreign land would be subject to US civil courts and laws. In wars past such people were tried by military court. And to the bleeding heart liberals crying about torture, my next post will be a link to a CNN story on what real torture is all about and this torture was performed against American soldiers you seem to hate so much.
Well, it would seem suiting since these days evoke a lot of 'first time in U.S. histories'
1st time U.S. Gov't was given absolute Carte Blanche over our privacy with respect to eavesdropping
1st time, prisoners were classified as 'unlawful combatants' to skirt the Geneva Convention; the irony being the majority weren't fighting any definition of the world 'war' and thus wouldn't even fit the POW moniker.
1st time VP wasn't considered part of the cabinet to avoid congressional testimony and 1st time. I could go on all night!

Bush's eavesdropping was on suspected terrorist in foreign nations no matter where they called to and from including the United States. Kind of makes sense to see if foreign terrorist are talking to terrorist cells already in the US and they didn't need a warrant for foreign agents. I serve 8 years in the Navy as a machinist mate second class and served on board the USS Iwo Jima LPH-2 and USS LaSalle AGF-3 during Desert Storm and Bosnia. Worked in the engine room of both ships.

You say Epsilon but do you mean Echelon? I'd love for you to go examine that and come back with some knowledge on the subject...
Bush's prerogative is/was distinctly different in that he can/could bypass FISA court and every other court. It's the difference between following the law and breaking it, then retroactively making everything all hunky dory.
Patriot Act: Cowardly, deceitful, and UnAmerican
Revised FISA: Making a bad thing worse
Military Commission Act: Downright Inhumane
Directive 51: Bush saying, "Just how stupid are my constituents"?
Sum total: A waste of tax payer's dollars and zero protection from another terrorist act; contrarily... a conduit for more hatred of the United States
As far as what branch... what does that matter? Why where? Why when? You sure ask a lot of dubious questions.... would you like my SSN too? All of that is moot to the conversation; more so to the context of my reply.

Foreign combatants? Of the 250 detainees still in Guantanamo Bay, do you know where they came from? Only a few are linked to 9/11. I'm not saying just let them go. Put them up for trial if there is such clear evidence against them.
