Why do we have to assume that monogamy is the only way to relationship?

From an evolutionary point of view humans are mostly monogamous; infidelity is not the norm. Humans evolved to be mostly monogamous because this was beneficial to the offspring.

Without adultery there would be many more serious crimes taking place. It is immoral, yes. It should be discouraged, definitely. But making it truly illegal would be a disaster.

During the early days of this country, in the U.S., adulterers would have an A branded on their foreheads!

But today, who would know what the A stood for? Some might think Atheist?

The government should have nothing to do with marriage, at all. Marriage should be a personal thing defined by the couples own belief system.

I'd also add to that: why do some have to assume that non-monogamy automatically means non-fidelity?

No marriage favors men. Nice to know one has a foot on the door and can walk away at any time with no problems.
