If you are familiar with trademark law your jaw might drop when you find out that the word "air" is now a federally registered service mark with the United States Patent & Trademark Office. On the other hand, you might be kicking yourself by thinking "why didn't I think of that".

Thank God it's not a patent or we'd all be paying through the nose.

The mark number is 4193718

To see the application go to: Trademark Electronic Search System (TESS) and search on "air".

Could you elaborate? Such as the difference between trademark, service mark and exactly how this affects anyone?

A service mark is a mark used when providing a service where a trademark is usually one used when selling something. That's a simple way to put it.

I just thought it was interesting that someone got a mark federally registered for "Air" which normally wouldn't be a trademark because it's descriptive. But I suppose as a service mark as long as they aren't providing a service for "air" then it isn't descriptive.

And it's cool that it was someone in Greensboro that got the mark.

Thanks!
Let's hope it doesn't go as far as Total Recall (original).
