Go read your purchase agreement. It will answer your questions, and it explains your legal rights, and your builder's legal rights.

You cannot just "walk away" - you have a legally binding, enforceable in court, signed contract.

You can negotiate a solution but the contract requires your builder to agree to any changes in writing.

Your situation is reasonable and understandable - try and work out an alternative house in exchange.

Otherwise, you are going to have to buy your way out, by forfeiting your money. Read the contract.

Pay attention to the "Termination" language - it is not easy reading, but it is written in English....

Any deposits put down for design center selections are almost always forfeited as well

Not sure what the op posted, but yes you can walk away - but you may forfeit all or a percentage of your earnest money. What you opt to do depends if you can afford to take that money loss hit.

Why are you walking away? If there are construction issues that can't be resolved, then you should be entitled to refunds on earnest money as well as deposits on upgrades, etc.

I don't know if Rusty got his answer or not, but we cancelled a Lennar contract earlier this year due to several reasons I won't go into now. We were reimbursed all our earnest money, but they kept the upgrade deposit from the design center. I hope that helps
