My son will be 4 this May and I have been trying for that long to get his name changed to my last name instead of his dads. His dad has had no contact with our son and I finally got him to sign a consent for me to change our sons name. I even filled out a petition for name change of a minor and filed it at the family law center, paid the filing fees only to be told now i need to consult a lawyer?? I cant afford one, and no one will help me figure out what my next step is? I filed everything got everything notarized so I dont understand what i have to do now to get a court date. Please advise!!

A judge will probably not allow you to change the name even with the dads consent. So you may be wasting money....I know this because my daughter went through the same thing with a signed consent from the father.

The judge told her she would have to wait until the child was old enough to understand what was going on.

But things may have changed.

I just throw my question in here. Can I download the forms to add a middle name ( adult ) ? Or do I have to go the the court house?

In my case I hope it hasnt. I have been trying for a year now to stop my son from being adopted illegally.

All i got was a phone call, no reason was given, I wasnt allowed to even talk it over with my son and I've been cut off since

How does that happen?

My parents divorced when I was 3...
Its forced me to grow up faster since my step dad makes me do work, while my younger, (I know it sounds biased, but wimpier) half-brothers don't hardly do work at all....

A lot of it seems unfair, but good luck to you OP, for changing his name, next time, contact a lawyer first...
Why is the name that big of a deal? I'm personally GLAD my parents didn't try to do this, FISK is so much better than ZIMMERSCHIED
Good luck with that, and life...

A relative did not like the name his father gave him. He at 11 discussed it with a neighbor lawyer. He had to wait until he was 14 to change it. He just filled out some forms, he went before a judge, answered a few questions, was told he was creating problems for the ladies in the school office. He assured the judge it was fine with the school, and that he was not changing his name to avoid child support payments or prosecution and it was done. No trouble.
