BOISE, Idaho — Four couples challenging Idaho's gay marriage ban this week asked a federal judge to block the state from intervening in their lawsuit, arguing such a move would unnecessarily add to their workload and complicate the case.

How do they think they are supposed to keep the state from fighting the case, when it is a state law- approved by the voters- that is being challenged. Would it not be the right and duty of the state to plead its case in defense of a law that voters approved? Just curious.

Good question.
I thought of the same thing. Atty. General Wasden wants to represent the state in this case. By suing the Governor and the county, I suspect there is a loophole in the law somewhere, as the state isn't mentioned, apparently, in the lawsuit. The lawsuit seems to me to have been very carefully crafted.

Or very badly crafted- no one will know until there is more written about it. Maybe the women's lawyers are only biding for more time.

For sure, Idaho's law is as restrictive as Utah's. But each was probably written differently. I don't believe our law faced a referendum; if not, then it was not directly approved or dis-approved by our citizens. Laws that are passed by legislation alone are easier by far to reverse than referendums, but a referendum can be reversed by a later referendum here.

I may be wrong, though- 2006 was a while back, and we get a lot of referendums on the ballot here frequently.

banjomike - I think I've suggested this to you before and IIRC you have thought about it a bit. What would you think about writing a book about Idaho? I've never read anyone so well-versed on Idaho before.

Thanks for the kind compliment, elko, but there are much more qualified guys than I am to write a history book.
In truth, Google is my friend when I write something I know I'm not current on, or if I think I am mis-remembering something. I like to fact check what I write before I post it. Getting a bad case of the rambles now and then have helped me, too- I have friends from one end of this state to the other, and I like to go see them once in a while.

Mike,

I know others, including me, who think the same thing. Who cares if you confirm your work with current technology? Go for it. You could start like Juneau and others on Blogspot and write about what you enjoy the most first. Or, you can write anyway that works for you.

Please consider it.

banjomike - the above is a good reason why you might consider writing a book about the state of Idaho. The things you know about the area in SE Idaho that you tell us, the things about the mountain ranges and how they are situated in the state of Idaho, man, most people don't know that kind of stuff. I saw a cool show on Public TV while living in Kellogg, ID, that showed the mountain ranges and the beatiful landscapes from the view of a helicopter. Wow, Idaho is vast in beauty. That was a really interesting special because it showed all kinds of Idaho geography from up above.
