WASHINGTON — This week a bill was introduced by U.S. Congressman Todd Tiahrt (R-Kan.) and U.S.Congressman Brian Bilbray (R-Calif.) called the Fairness for American Students Act that would close a loophole in current law that several states have used to provide lower-cost college tuition to illegal immigrants compared to tuition rates U.S. citizens from neighboring states have to pay. Kansas and Nebraska are two of the states that currently offer in-state tuition to illegal immigrants.
The landmark 1996 Illegal Immigration Reform and Immigrant Responsibility Act prohibited illegal immigrants from receiving in-state college tuition, but nine states so far have used a loophole allowing them to disregard congressional intent.
"U.S. citizens should not be forced to subsidize college tuition for illegal immigrants, and we should certainly never pay higher college tuition than someone in the country illegally," said Tiahrt. "Congressman Bilbray and I have worked hard to ensure the loophole is eliminated through this legislation."
Kris W. Kobach, Professor of Law at the University of Missouri-KC and former Counsel to Attorney General John ********, is a lawyer who is intimately familiar with what states are doing in circumventing the existing federal law that bars states from providing in-state tuition to illegal aliens. He successfully sued the Board of Regents of California for violating the law and is currently litigating against a similar law in Nebraska.
"This bill will do much to reinforce the rule of law in immigration," said Kobach. "It will put teeth into the existing law, which doesn't carry a large enough penalty against states that disobey."
I find it intersting that all of the States Im about to list wrote their own laws dealing with students in THEIR OWN STATES...This is a STATES Rights issue...
Several states -- Texas, California, New York, Utah, Illinois, Washington, Nebraska, New Mexico, Oklahoma and Kansas -- have passed state laws providing in-state tuition benefits to illegal aliens who have attended high school in the state for three or more years. Similar legislation is pending in Florida, Hawaii, Maryland (legislation passed, but awaiting governor's signature), Massachusetts, Minnesota, New Hampshire, New Jersey, North Carolina, Oregon, South Carolina, Tennessee and Virginia. (Connecticut and Wisconsin also passed such a law, but their governors vetoed it.) The Nevada system of higher education does not consider immigration status for in-state tuition, but does require it for a state-sponsored scholarship. Also, some schools in Georgia provide in-state tuition benefits to illegal aliens. The Texas law also allows illegal aliens to receive state student financial aid.
If the People of these States want to change their laws now, its their Right...
But they are only going as far to say, That illegal students are not intitled to "IN-STATE TUTION RATES"...They have to pay the Higher "Out-of-State Tuition Rate"

Sort of like cities and states enacting “Sanctuary Laws” notwithstanding the federal law prohibiting aiding and abetting illegal aliens.

There wasn't enough support of the bill in NJ so currently it is in the scrap heap...thankfully
