It is a familiar story...and there are worse. One lady in Sun City had a home that was basically free of golf balls initially. Then came the Titaniums...and suddenly she was in reach of the tee. The moved the tee some but not enough.

The case law is mostly settled. One who buys on a golf course has at best an action against the golfer who hits the house. No action is possible against the course or, in this case particularly, the Association. There has been a recent exception in the south but nothing changing the basics so far.

However the lack of the disclosure could cost Pulte. The lack of recourse against a nuisance to the home is clearly disclosable.

It is of course clear why nobody is going to give the home owner an inch. There has to be a ten thousand of those places in Las Vegas....

How about the people that buy homes around the model airplane landing strip that sign a waiver to move in and now complain about the noise of the aircraft.

Not the brightest home buyers. Not sure why they are made to be sympathetic characters in this story. They clearly are not golfers or they would have recognized the location of the home relative to the tee and the liklihood of getting hit. I suspect many of their neighbors are golfers and really don't mind or expected a high frequency of incoming balls. Otheriwise this reporter should have had more than one couple to interview for the story.

The only thing stupider I could imagine is an oceanfront buyer who was surprised by how much beach square footage he lost when the tide came in.
