Again don't bet on it. As a practical matter municipalities just trim them. But they can make you do it. If the tree interferes with a right of way the owner can be billed for the cost of trimming it. It is your tree until it passes off your property...It is still your tree but now your tree is their nuisance. They can fix the nuisance. Again though it would get complicated if their trimming really damages the tree. .

However if it is on your property you can certainly take it down. If you are in an HOA I would check though to make sure they don't have a say. You can read your docs...our you can ask.

I feel your pain! I hate Pine Trees! they don't belong in the desert and they post a fire hazard when the needles dry up and no one picks them up. Pool guys worst trees are Mesquite, Sumac, Pine and California Pepper.
