It's been proved now that sleep-deprived drivers are as much a danger on our roads as drunk drivers. And do sleep-deprived drivers go through this same ordeal when they're arrested for unsafely driving with two hours sleep?

A nurse where I worked did a double shift one time, on her way home she fell asleep at the wheel, jumped a curb, and luckily, ended up in an abandoned
lot.

She could have crossed the center line and killed someone.

A social worker that worked in the ER left after a shift one morning. He was brought back in an ambulance about an hour later. He fell a sleep on the way home and hit the rear of a parked semi on the highway. I don't suppose he ever knew what happened. Needless to say, his injuries were fatal. It was difficult for most of the ER staff that worked with him to now work on him and subsequently lose him. Those were some really 'dark' days.

Sleep deprivation impairs not only driving, but job performance too. That is why I don't understand why they still make interns do 36hr shifts. Granted, they do get to sleep during that time, but their performance is far less than stellar. If sleep deprivation is used as a torture technique for the CIA (and other 'law enforcement'), why the heck to they mandate it for doctors? Something seems a little whacked, don't you think?

I was pulled over last night on my way home from the outlet mall. I was alone and not speeding. It was on the 15 just after the St Rose Parkway exit. I think it was a set trap because there were several cars and a DOT truck there. Anyway, they said I was weaving IN MY LANE. I hadn't had a drink in at least 2 weeks so I wasn't going to hesitate to do anything they asked.

It must have been obvious I hadn't been drinking because they checked my license and let me go. No tickets or anything. They were quite courteous but it scared me!

EXCELLENT! Folks don't believe me when I say this and those are the people that get trapped in a net. They always think the cops hold the power. They don't, UNLESS you talk to them! Any time I've had issues with cops, and believe me, I've had them, I always tell them... do what you need to do and we'll save it for the court room. Yup, can you hear the brakes?! LOL

Now, don't get me wrong. If you intentionally violate the law and you intentionally harm someone, YES, your arse should suffer the consequences of your actions. But, consequences are a component of sentencing after trail.

I thought you used to be an officer? Why would an encounter with them scare you? Did you admit to weaving in your lane? Or did you just say "Is that right?"

Not so. Many states have successfully argued in their state supreme courts and won. Many used the implied consent theory, while some states argued the need for expedited blood evidence as the reason it should fall under a warrentless search.

Folks should really watch part 2 also. Pay attention to what this officer/former officer says between 17:28 - 17:37. It is SO true!

If you guys remember the argument in another thread Clark Griswld and I had recently this is what I was saying he was doing -- making the defense prove something didn't happen when it is not the burden of the defense, but the burden of the prosecution to prove it did happen, and this tells why.
