If he fired an "AK-47" he should go to jail. They are not legal.
Semi-auto variants of AK-47s are legal in the US. And it seems his was also legal in Nassau county if I read the article correctly. The fellow should have stayed in his home.
Had nothing to do with the gun he used, it's that he walked outside and fired it off four times that's illegal. Warning shots are, somewhat illogically, illegal. Don't discharge your weapon unless you reasonably believe that you're in imminent risk of physical harm.

*sigh* I really wish people were more educated on this topic. Bet half the people in here will call the AK-variant he used an "assault rifle". LOL.

20 guys threatening to kill him is enough show of force to reasonably believe your life is in danger. Considering the police, FBI, and Border Patrol have all put out notices about MS-13 and their violent culture, I'm giving this to the homeowner. The law states that discharge of a weapon in defense of self is legal. Defense of property is not.
Should he have waited until his wife was being raped and he was surrounded before he took some action?
there is no such thing as legal warning shots.. the law is such that everything is reactionary. they have a bat ,you can have a bat .. they produce deadly force you can use deadly force.. threats dont count...
who ever escalates things to the next level beomes the bad guy...
they had not produced a weapon yet and so since he introduced deadly force first hes the bad guy.
if someone breaks into your car and you confront them with a gun they are committing a petty larcey, you become the bad guy threatning their life.
i know, it dont sound fair but thats pretty much the law in most states, you can only meet force with like kind and not what you think they will do next.. you can only react to and not introduce first.
had someone displayed a weapon first this story would have had a different outcome for the homeowner.
