What?! No you only go through their insurance in a case like this. Why would you want to potentially get caught holding the bag? Even if your insurance company keeps you shielded from it, who's to say they won't raise your rates in the end because of other complications? Completely up to them - don't involve them if you don't have to.

Anyway, ballpark for 6 months I'm paying $300 comprehensive on an '08 X5 and $250 liability on a '97 Civic. Small delta, go figure. Over 25, nothing against record, Allstate.

BTW, why are people paying comprehensive on such old cars like an '01? And the rate is too high.

Well it depends on the book value of that 01 vehicle. In my case I recently bought an 01 Toyota Sienna($6,900) and since I have a loan on it I have full coverage. Once the loan is paid off next year I will decide whether or not to carry liability only.

I have Geico, and my premium is $1,056 a yr.

I guess I worried about such things when I was a young driver but that is what I pay insurance for...for them to INSURE me. Long term drivers, with good records, do not have to concern themselves with putting in claims for accidents that are not their fault. I have never heard of an insurance company ever raising rates on someone who's car was not even moving.

Your insurance won't be surcharged if you aren't at fault.

If the scenario you laid out is true and USAA is giving you that hard of a time about paying your claim, here is a simple solution. Tell them you know your rights under NY state insurance law and you know they have 30 days to pay or deny or delay a claim. Once they have the info they need they can no longer delay the claim. You want to hear that a check is being cut in the next 48 hours or you will 1) contact the NY state insurance dept and file a complaint (insurance companies HATE dealing with these, even if they know it won't be upheld - it's a major headache) and then 2) file a small claims summons.

There's no reason in the world why a claim should not be paid once everything is in order. Insurance companies have the right to investigate a claim, no matter how long it takes, but if you are 100% sure they've got their insured on record, then they have to pay.

If you're fudging the details and they really do need to continue to investigate, well then Gpsma is right - good for their policyholder. Their duty is to their insured, not to you.

No, they've agreed to pay. Just dogging it on the payment because their peopel havent signed off and people on vacation, yada yada. Had to use the NYS insurance dept./lawsuit stick on them this past Friday. Guess what, check came in the mail today.
