Well after 4 years I finally received all my permits and home was legal, but in doing so I was forced to remove an old shed. What I did was remove the old shed on one side of my property and installed a new (second) shed next to the first shed (has permit). I was given green light on tear down of the old shed and thought everything was okay as they inspected it and stated my entire case would be closed. Today about 6 months later, violation in the mailbox. So here we go again.

I believe this second shed needs a variance if I am correct?
How bad is the variance process and is it worth it for a shed?
Can code enforcement enforce anything since they cant go in my yard to verify the shed is there?

I'm tired of paying money to the town.
I'm tired of going down there.
They just received about $5,000 from me for permits last year.
I requested a FOIL from the town what will that even show me?

Thanks for your help...

BTW Town of Hempstead

What size is the shed? I don't know what town you are in but most have a size below which you do not need a c/o.

Pretty sure in TOH you can only have one shed on your property.

How far from the set backs? That may be the problem.

If the old shed was legal why did you install the new one NEXT to where it was? As nuts said, the setbacks are probably your biggest issue.

Now that I don't live there I have to say Long Islanders' obsession with sheds is a little odd.

What is the FOIL request for? What info do you think they are hiding?

I am in deep trouble then.
I have 2 sheds , one small and one maybe 10 x 10 and already found code enforcing card on my front door.
But don't know for sure for what complaint?
too nervous to call him.
what should I do?

What are you too nervous about? Whatever happened, happened. Don't volunteer any information. see what complaint they have.
Far as I understand, they don't go shed hunting, most people don't have permits for one. likely its something else. It could be anything.

Man/Woman up and make the call

In most (if not all) Towns you can have one shed (conforming to the Town's size limit) without permit
but will need a permit for the second shed, sometimes a variance, and after an inspection the Town will issue a Certificate of Completion.

Not true. In TOH you need a permit for any shed.
