I know that corner property fences in Town of Hempstead are now allowed (as long as they aren’t adjacent to a neighbors driveway). I already have a permit for my 6 ft fence on my corner property. My question is- what do the rules state regarding privacy trees? Are those considered “fences”? I’m hoping to plan some that go higher than 6 feet to add privacy to my backyard but I wasn’t sure if they face the same restrictions as the fences.

All the corner homes by me that have shrub or tree “fences” drop in height at a certain distance from the road. So my guess is yes they have the same code rules as a regular fence.

You'll need separation between shrubs, either physical space or different species. If they're close enough together to be considered a living fence, you'll be held to the same height and location restriction.

Also in regard to corner properties: some restrictions were loosened a few years ago. Fencing is now permitted in the same manner as other properties (ie. 6' to the sidewalk in all but the primary front yards, excepting regulations for setbacks near driveways and the actual cofner). Used to be nothing over 4' past the end of the house on either side.

Yes the fence I already have - and it's approved and permitted by ToH. So I have a 6' fence right on the sidewalk. I am looking to put privacy shrubs (in my yard - on my side of the fence) to privatize the yard a little more. From your other post, you said I could as long as there are gaps? Is there a requirement as to how far apart the shrubs have to be?
