"Alleged" is the usual terminology until a conviction is secured.
The .18 BAL is not alleged, it is a fact. If he admitted that he was behind the wheel he should have been locked up. It still needs to be established whether he was driving, I would expect that the girl with him had a similar problem since it was 4AM.

Where did it say .18? I didn’t see it stated I don’t believe.
That was My argument before If he did not admit he was driving this is how he ended up at this point.
I wonder if they were able to get the black box recorder and get information from that. Civil lawsuits result in the recovery of that information once in a while. Probably takes a while.

A BAC of at least .18 and nobody arrested at the scene even though NCPD and NYS troopers were present?

Sounds like he went to the hospital and his blood was subpoenaed. Otherwise, they would have no clue what his BAC was.

Driving isn't enough to lock him up unless he showed clues of intoxication or admitted "drinking".
In Suffolk they hid chopped up body parts according to newsday and couldn’t even get bail. Crazy times.
