Hello,

Are there any Lawyers here? I have an issue regarding 'Right of Way' here in Maine. I'm not looking for free legal advice, I would just like to chat about the situation and hopefully learn what options are out there.

I have been on planning boards in Maine towns beginning in 1973. I have seen a number of these issues and just attended the Maine Bar Association seminar on land use and rights of way. That said, I'm not a lawyer and don't play one on TV. Ask away. If I know I'll tell you.

Find an attorney who specializes in property rights issues -- the Maine Bar Association can give you a list. Often the first visit is free, and you can learn about your options from someone who actually knows the law.

There are a lot of superstitions about land law in Maine. You may have heard of a parcel of land that is "landlocked". However, there is no such thing as "landlocked land" in Maine.

What are the new rules? The county commissioners can't give you a right of way. You can try to buy a row from abutters.

NMLM is correct the state past a law where a land owner can not sell a back lot with out a r.o.w the problem being the law has some holes in it.
read the fine print befor you buy.i no a guy that bought some land and couldnt put a road in. his deed says easment to foot traffic only.

I also have a problem with a right away. My neighbor put a gate across it with pad locks so I can not use it. How can I legally get him to take it down without using the court system.
I would greatly appreciate any ideas.

I remember hearing that you are not considered "landlocked" if you can only get there by boat. Do you know if this one still holds true NMLM?
