It blows my mind that people automatically assume that a custodial parent, seeking money from her ex, is "just looking for money"... whether or not the deadbeat is a disabled vet, his children still need to eat. Food and shelter cost money. Why do non-custodial parents not understand this basic fact of life?

I think it was said "if he is paying child support why go after disability"
The OP never replied when asked more than once if he was paying his support. if he isn't then by all means she should get what her kids deserve!

That makes sense to me now. I'm pursuing financing on an investment property and I'm looking at 6.875 with almost 3 discount points. I thought that was out of whack until I started calling around to compare. They say the rate is because of the low loan amount and the fact that it's an investment property. And I guess rates went up the last few weeks.
Before you jump me, notice the OP doesn't even *know* when the ex retired-the divorce is most likely not recent.

Don't misunderstand me. She should get *everything* she and the children are entitled to. She should not overachieve to go after more (e.g., GI Bill is a veteran's entitlement unless he *wants* to give it up or a judge forces him to).
I had to comment on this subject, I receive 100% Service connected VA Compensation and pay court ordered child support that is paid from my compensation payment, but my ex-wife put in the paperwork to have an apportionment also taken out my monthly payment. So, she recevies monthly child support and this apportionment, the apportionment at this time hasn't been paid to her yet, the VA keeps it several months for the actual payment to be paid. I right now am working to get this apportionment stopped.

I've hear support interpreted both ways, by the court. Court have ruled "disabilty" is for the soldier AND his family, to get around ESTBLISHED "legal" precedence (states a vet va "benies" are NOT to be touched, PERIOD.)
They CAN take Va benifits, though, VA (as far as I know) will not give $ directly to Child support. The will direct deposit the cash, and child support can take whatever they want from non-custodial parents bank account.
Like the others, I question your motives & ask u (as a fellow combat vet) leave the guy alone, if you're getting money "for your kids".
You want him to snap, go to jail, have his credit ruined? Is he REALLY your kid's father? Then why screw up his life? Go on with your life & let him do the same.

VA disability is paid at a higher rate with dependants.
Probably won't happen in this case with a divorce though.
