I live in a subdivision in Murfreesboro that is attempting to start a HOA. There has never been a HOA in this subdivision before. They held a meeting last month and just sent out flyers yesterday that stated that 51% of the homeowner's are in favor of the HOA. They have set up another meeting to discuss the who would be on the board and the fees that would be charged. I have talked to a lot of the people in my neighborhood and they are against it, along with me. We don't have anything in our subdivision but a front entrance that needs mowed and landscaped. For this purpose, we already have an Architectural Review Committee. I have a hard time believing that they got 51% of the homeowner's signitures. Would they be required to show the signitures? I'm afraid they tricked some people into signing something when it was really for the HOA. Also, does it really only take 51% to start a HOA in an existing subdivision that has been around for years? I really find that hard to belive. It seems they are moving forward. This really isn't a good time to be asking people for more money, when people are either not getting raises or getting layed off. Please help!

They can't require membership. If it had been in place when you bought your house, it would have been a voluntary association. You bought the house without this requirement, however, so they can't force you to join a newly formed HOA.

HOAs are formed at the time the subdivion is formed they can't force you into it. They could have some sort of community board but it won't have the teeth an HOA has.

Mad Fiddler and Septimus are correct!!!!!! They can get as many signatures as they want, but can't form an HOA.

Well, no, if they get everyone's signature, they could form an HOA. But they can't bind you to one without your consent.

I disagree. I don't believe it is that easy to just get signatures and form an "actual" HOA. There would be many legal issues associated with that. If it was that easy, there would be many more HOAs than there are.

Just a quick response. I have recieved letters from a lawyer and they said they are going to put a lean (sorry don't know the proper way to spell that???) on my house. Do I need to hire a lawyer or just go to court by myself...if I ever REALLY get a court date. So far, it has been just threats. There are about 20% of the people in the subdivision that haven't paid the HOA anything.
