Hi guys. I'm kinda new to Jersey. The other day I got two traffic tickets. One was for improper passing because I crossed the triangle divider thing on at an exit to merge in. IMHO, there was no earlier place I was able to merge, so how else was I supposed to merge? The second was, for some reason the cop was out of his car and waved me forward... or at least it appeared as so. Then he ran in his car and followed me and pulled me over for a second violation for not following his directions, because apparently his hand gesturing me forward meant to pull over to the side??
I guess he must've been having a bad day or something; a shame he has to take out his frustration on motorists. I think these two tickets are totally ridiculous, especially the second. Anyway, my main goal is to get out of this with the least points and least hassle possible. I have used one plea bargain before a few years back, so I think I still have one left. Is it possible to plea bargain out of it? Is it worth getting a traffic lawyer?
What an a-hole! Did you explain to him that you were confused as it relates to the second violation?
Indeed. He wasn't hearing it. He was refusing to listen and then came back with the two tickets. When I tried again, he walked off after handing me the tickets and explaining the court date. I tried to explain I have an extremely good driving record and it looked like he was waving me on, but he just said he would've pointed differently if he was doing that... ridiculous. I was reasonably polite and he just wasn't interested.
I'm wondering if maybe I can take the plea bargain for the first ticket and not guilty on the second. It's such an annoying hassle, though.
Often they will let you get out of one of the tickets in court and you should be able to negotiate the other one down. I don't think there is any guarantee on that but years or decades ago I remember one judge who wouldn't hear of anything over one ticket per incident.
It's up to the prostitutor but usually they will make you a deal to change one to Unsafe driving while dismissing the other. Its more of a hassle if they have to call the cop in to court for a trial so they often do that just to rob your money. The unsafe driving deal is no big bargain, costs a lot, around $475 or so and still shows up on your insurance record as unsafe driving 0 points.
Insurance may question you about it but you can always tell them anything you want, it wasn't you, you where parked, you broke your ankle, you dog ate the homework, etc.
The original deal with the NJ "unsafe driving" deal was twice in 5 years but within the last year or two I heard a judge advise that the NJ legislature recently changed that to just twice, no resetting the clock anymore. You're right about any of the other options. Actually if everybody's in a conducive mood and you have no more of the unsafe options left, you might get a real zero pointer.
Sometimes, years ago you could ask the original fuzzolini before they write the tick for a non-pointer like a seat belt or not finding an ins card. Luckily I haven't had to do that in decades, don't know if they'll still do that but you could always try.
