Walking home through the east 20's and stopped to converse with friend on a public sidewalk outside of some bar. Never stepped inside of bar, wasn't smoking, had no intention of even stepping inside of bar, and wasn't even talking loudly. Bouncer comes along and orders me to step inside roped off "designated smoking area". Claimed that he was under "city orders" to corrall private citizens into penalty box on public property. That sounds totally incorrect. Sounds like that bouncer took the law in to his own hands as he seen it.

Wow....I hope that bouncer was just a jerk and they can't really do that. If they actually can do it I have to ask one thing - When are we going to start taking it to the streets!!!

He wasn't under "city orders". The bouncer probably thought you were a bar patron stepping out for a smoke and herded you into the designated smoking area. The bar can be fined it their patrons are breaking the law. All you had to say was "excuse me, but I'm not a customer of your bar and I'm not smoking". He probably would have asked you to stop loitering in front of the bar.
I made it quite clear that I was not a patron of his bar. Regardless, I stopped to have a quick, quiet, 2 minute conversation on a public sidewalk with another private party, property on which I pay taxes on to help maintain. To have a private security guard thug acting on the belief that he had "city authority" to corral private citizens into a designated zone is frightening.

It may be "'public property" but the business owner is responsible for the portion of the sidewalk in front of their business. How do you know that bar hasn't already been warned or fined for people loitering or smoking in front?
Your conversation wasn't "2 minutes" -- had it been, the bouncer wouldn't have come out and asked/told you to move. And why would you stop in front of a bar to have a conversation???
The security guard was probably told by the owner(s) that he better keep the sidewalk clear and unobstructed or he will be responsible for any fines the bar incurs.
Whatever the security guard thought or was told is not the city's fault. How are you going to blame "the city" for what a security guard told you??????
