I am a divorced woman living in a private house with my mom. I have an empty basement apt since my son moved out. To have some renovation work done in my home (since I am on a limited budget) I worked out a barter deal with a contractor who would live in the apt with his young daughter in exchange for rent. I have since found him too difficult to work with and have asked him to move. We have no lease, its all verbal and I have paid him some cash (except for written estimates for his contracting work). What are my rights in this case? Of course he doesn't want to leave. And yes I know through hindsight some of the things I could have done better but this is presently my situation.
Put his property boxed up in front on the house. He does not own the house, nor does he pay rent; therefore, he has no right to be there. A verbal agreement is not enough when it comes to real property. Give him a letter stating that he has 30 days to vacate and have a witness (a police officer). You need to act quick!

You might be right, but is to smart to( use) somebody for their convenience, now he acts like a victim . probably to look for somebody else to jammed!! As you see, no lease , not taxes, everthing under the table. That's what he gets for USING people . So if his issue is about( budget), why don't go and ask him for a montly rent? All this excuses just to clean his hands..
with no lease they better be able to prove what the rent is supposed to be if they ever have to take the tenant to court for non payment. many times those that try to do everything under the table take cash only.. good luck getting a judge to open that case.
The part that I don't see is, when they agree to rent the basement ?, under what terms ? And if they ever said to him it was temporary . Now here's the catch !! She was giving him money!! Hum? Relationship!!!!!!!! or it's that the work that this guy did in her house was over the budget that she has. ?? At this point the one looking real bad is OP.
