Very few qualifies as criminally insane now a days especially in high profile cases altough they are showing clear psychotic symptoms. Jeffrey Dahmer's diagnosis was Necrofilia (IMO it's not a mental illness it's a fetish) but was sent to prison.

Getting drenched in GASOLINE in an elevator is DUE CAUSE to protect your life. There would be no need to wait for it to be lit.
As far as the 'spark from the gun" thing goes, I suppose it is a possibility.
