its up to a judge... you dont have to pay rent as any back rent owed will be thrown out but no one can say if a judge will award you all your money back. just prepare to move .

Get a copy of the rental agreement and take it to the housing court, yes, stop paying and move out

You may not get any money back but you can get time to hold on to the future paychecks that would be going towards rent.
Dont be afraid of anything or anyone thats first thing cause the person that rented to you more than likely knew it was illegal to house you in their basement they just didn't think they would get caught or found out so fast. If push comes to shove call red cross and every other agency you can find or think of and ask for help and advise just like once you calmed down from the shock of you might being put in the street you reached out and made this post. Remember that commercial the educated consumer is our best customer - Nowadays its opposite landlords and unscrupulous types pray that they have a trusting and ignorant to the process person to take advantage of and prey on. If this is your first time let everything you go through be lesson learned for future protection from this incident happening again. HPD can help get you relocated if they were the ones that came to check and found the violation of the basement conversion or housing someone illegally.

You don't have to do anything unless you don't like the place. The illegality is the owner's responsibility not the tenant's. Lots of people live in illegal basements-- if you're ok with it you might as well stay put.

I wouldn't recommend this.
especially if the basement was deemed ilegal due to a fire harazd.
