I have a tenant living in the apartment over my detached garage. Background - she is a friend who desperately needed somewhere to live last summer, so we allowed her to move in there. We gave her a 1 year lease which ended yesterday. Because she was a friend and we just meant to help her out, plus we were on short notice, we did not obtain a renters license or occupancy certificate. Basically we didn't know we needed that because we had never intended to rent out the place.

Fast forward a year, and she is not paying rent. We have sent her request to vacate in writing, twice, by 12/16, neither of which she has responded to. I would like to file a notice for eviction with the court, but if I don't have official documentation what are my rights and what is the process to get her out?

ok did you send the notice, return receipt? you need proof that she got your request in writing.

We sent 2 emails, but tomorrow my husband will post on her door and we have a video camera to see when she gets it. As for the friendship, she blew that months ago.

I think you'd have to evict her even if she hadn't been paying rent because she has established residency.
