Does anyone know of or know where I can find a real estate attorney who's also a real estate broker who can assist in the short sale of a property?

You really don't need an attorney for a short sale unless there is something more complex about the situation. Any real estate agent can negotiate the process with your bank and try and get a short sale for you. And if you are buying a short sale, then your buyer's agent can handle the deal for you, unless there is something major that comes up. However, I will do some checking around and see if anyone knows anyone.

Being a real estate broker is a full time job. Being an attorney is also a full time job. If there were a broker that is also an attorney, I would not want to use him/her. I would prefer a real estate attorney who only specializes in real estate law, and not also acting as a broker.

azcater is correct in that it is not necessary for an attorney to negotiate the short sale. Many realtors today are trained and experienced in handling short sales.

Just ask some realtors how much training they have had, and how much experience they have until you find one you're comfortable with.

I also do not think you would need a real estate attorney for the negotiation of a short sale.

My bosses are very experienced with short sales and very adept at getting them closed, as are MANY other agents in this market, I'm sure.

Default Negotiating a short sale with your lender

I believe an attorney is the best person to start with when thinking about a short sale and to do the actual negotiation between you and your lender.

You signed a legal contract with your bank. Is a real estate agent, even one knowledgeable the best person to evaluate your legal obligations and provide counsel? I think not. Moderator cut: no advertising allowed You may be asked to sign a promissory note with the bank. Is a real estate agent the one to direct you in this decision? Again I don't think so.

Mind you, a solid real estate agent is important in the short sale process. They can do wonders to market and sell your home. Plus, a good agent knows how to keep the potential buyer in the game while the lender spends months deciding to move forward or not.
