That's a good question. If it was a mom and dad of 4 requesting rainbow cupcakes for their 6-year-old daughter's birthday, would the bakery have refused the request? Or would they have realized that a rainbow is just a rainbow? Even when it is being used to represent the gay community, it's still just a rainbow. Even if it were possible to convert people to homosexuality, I think it would take a little more than a rainbow in your visual field.
You know, when I first read this thread I laughed--I'm pretty sure I've bought cupcakes decorated with rainbow frosting at Sam's club for my kids to bring to school as a treat on their birthday...

I think businesses should hire who they want but what job applicant mentions their sex life in a job interview or on a job application and what business person tells someone why they weren't hired when the reason is personal?

This country was built on freedoms, and when we start telling people they cannot be stupid, that means someone gets to decide when we are being stupid.

If a business owner wants to restrict their business opportunities based on their personal prejudices, I believe they have that right. I also believe I have a right to not give them my business, because I don't want to condone that type of thinking.

As always, when we get what we give.

Don't sweat the small stuff. Prejudiced people are about as small as it comes.

They have the right to refuse service to anyone they choose. They may be open to the public, but they are a private business. The people turned away can go elsewhere.

Gays are not a protected class so yes, the bakery owner can refuse to serve them. Only time for a business owner to refuse service to someone and it be considered "illegal" is if it for reasons of race, gender, age, etc (e.g. a protected class).

Depends on where you live. Many states do include sexual orientation in their nondiscrimination laws.

Regardless, this case doesn't have to do with discrimination against anybody. It's simply a refusal by a private business to fulfill an order based on the product itself, and it's completely legal for them to do that.
