The media and many posters are portraying this as an act of vengeance by Mrs Edwards, but the truth is that this may have been a mutual agreement made by the two long ago. Mrs Edwards had her own wealth, and John Edwards is quite wealthy as well. They were both lawyers. It's certainly not unreasonable to think they discussed what would be in the best interests of their children, and acted accordingly. I think it's unfair to Mrs Edwards to characterize her as vindictive at this point. Especially when she didn't live her life in that manner.
Their divorce was not final. In North Carolina family law, a couple can obtain a divorce only after they have been separated for a year. She passed away before this could happen.
Separated but not divorced spouses still have inheritance rights under the law.
No one will be hurting in that family financial, just the deep loss of a mother to those kids, and yes, that includes John.
