The president cannot pardon someone for a state offense. Article II, Section 2 of the Constitution gives the president the "Power to Grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment." (For a discussion of what "except in cases of impeachment means" and whether the president can pardon himself, read this "Explainer.") That means the president can pardon only for federal crimes.
You liberals Really need to study some Constitutional Law before you try to justify ignorance.

Then why did Bush try the same thing with Jose Medellin back in 2007? He was turned down, but they did hear his argument.

You believe GW Bush to be a RINO, correct?

No, he's not.

He's trying to GARNER as many hispanic votes as possible for his next election.

This is a great vehicle for that effort.

Remember, he's (O) is ALWAYS in campaign mode. After getting this case won, he'll forget who the hispanics are and what they did for him, you know just like always.

So, you're saying the Tea Party members are just a cross section of America?

My sister is a reporter in the news media, a (shudder) democrat and she helped organize the Tea Party group in her city. So using your 'select' list, yes they are in large a representation of Americans.

And drop the offensive bagger crap. We all know what you mean by it but have no gumption to say it here. You'll be taken a bit more seriously if you show some respect for others views.

Yeah, that's not an important detail or anything.

Admit the mistake, have the retrial and if he's found guilty again, go from there.
so the point here is to please mexico? hell no! we don't NEED the cost of a retrial. we are BROKE as a country. the guy was CONVICTED AND SENTENCED ALREADY.

the family of the murdered girl needs JUSTICE.

liberals are getting so out of control that they can't see the forest for the trees.

our society needs to be protected from THUGS who would do us harm.

you want more proof that we are broke?:

Capitol Fax.com - Your Illinois News Radar » This just in… CMS decrees no union pay raises at 14 agencies, boards, etc. - 29,905 workers, $77 million or this http://market-ticker.org/akcs-www?post=189254

no union pay raises in illinois because there is no money, and this is JUST THE BEGINNING. so keep trying to force americans to spend money tilting at windmills while the country falls apart around you.

All right; let's assess the "damage" done to his case by them not advising him of his right to a consular official.

As in Miranda; I suppose any evidence garnered from his admissions while not having his rights observed would then be "fruit of the poisoned tree"?

Did he request a lawyer? Was THAT request denied? If a lawyer was present and protecting his rights, would this not be deemed adequate by a higher court in any case, as no consular official could provide any different or better advice in any case?

Was the search of his property performed under the proper "warrant' requirements?

If it could be proven that his failure to have consular assistance had materially damaged his right to a "fair and impartial" trial, perhaps there would be reason to re-try the case.

Any party, however, would be foolish in the extreme to allow; suspension and subsequent bail conditions where the outcome, without fail, would be this guys beating feet back to Mexico to evade forever any semblance of justice!

Obama could grant this guy executive clemency any time he feels like it, but doesn't dare do so with an election coming up. Once he (heaven forbid!) gets re-elected don't doubt for a second that he'll do just that.
