Then Jesse can walk down the block and go to BK where they will take his order for a whopper.

Meanwhile he and his minions scream conspiracy that he was denied a Whopper at McDonalds....and he gets more traffic to his website, maybe a new TV show and whatnot. Jesse is crazy like a fox.

Seriously google it, he is all over CNN etc. great publicity for a faux suit that cost him almost nothing.
For publicity? Doubtful. Jesse Ventura has the highest rated show on TruTV. It's not even on yet.

Say what?

I caught the world record bass this past weekend I just haven't caught it yet.

Clearly you and Jesse are holding out on the good stuff.

Me? How much will you get for that bass? Funny how Jesse got no publicity for his case against the TSA. What a surprise.

Is it constitutional to make a law that has to go straight to the appeals court and bypass the lower court???? BTW, the same appeals court which unanimously rejected 4th amendment claims out of hand and rejected lack of studies on health effects of the scanners out of hand? All of this is very suspicious, and I think Ventura did what he did more as a symbolic gesture.

Of course the people who love to get groped at airports don't care about these pesky constitutional issues, they get what they want for free instead of paying for it under the guise of "feeling safer" (even though it's been proven over and over that groping and nuking doesn't make anyone safer).

A federal judge Thursday tossed out former Minnesota Gov. Jesse Ventura's lawsuit that argued body searches at airports violated his right against unreasonable and unwarranted searches.

In her dismissal, U.S. District Judge Susan Richard Nelson didn't address the merits of Ventura's suit, but rather said she lacked jurisdiction to hear the case.

She wrote that Ventura was challenging a Transportation Security Administration order and that the law says such directives can be challenged only in a federal court of appeals.

Yeah ... what a wacko ... he wants the government to honor the constitution!

Look, the issue isn't very complex ... the Federal Court says it has no jurisdiction in a case involving claims of violations of constitutional protections, which to any rational mind should summon the obvious question ... "If the Federal Court has no jurisdiction in such matters, who the hell does?"

They claim that it is an "Appeals Court" issue, which is totally absurd. The Federal District Courts decide cases based on facts and evidence, with a jury of your peers (the people), while the Appellate Court does not decide on case facts or use juries. The Appellate Court only reviews cases to ensure proper procedures and constitutional law was observed during the conduct of the case, and if violations are found, the Appellate court can remand the case back to the District Court to be reheard.

Clearly, this is nothing more than a very transparent tactic to circumvent and deny Mr. Ventura due process, ostensibly to prevent a jury from hearing, and ultimately deciding that which most rational people already recognize ... that the behavior of the Government and TSA is wholly out of control, and indeed represents a violation of Constitutional rights pertaining to unreasonable search.

Far from being a radical, Mr. Ventura, the ex Navy Seal, and former Governor understands the flagrant and unlawful behavior of the TSA, and now understands that the corruption runs so deep, there appears to be no recourse, even through the Courts.

And he has every reason to be disgusted by this, but I think what he finds even more disturbing (as do I) is the prevalence of attitudes such as yours in thoroughly failing to understand the implications of the Court's decision.

So, perhaps a more simplified explanation will help you to form a more rational opinion. This refusal to hear the case simply says .... the government, aka Homeland Security-TSA can do as they please with you ... be it running you through a microwave oven or sticking their hands down your pants and squeezing your genitals, or any freaking thing else they care to do, and there is not a damned thing you can do about it!

And don't bother whining about rights, constitutional or otherwise, because we, the Federal Courts are corrupt to the core, and no longer answer to the people of the United States, nor do we bother with such mundane issues as law and justice, or that damned piece of paper called the "Constitution".

That, in a nutshell is the decision by the Court.

OR

b) Jesse and his legal adviser know full well their suit would be struck down but it's cheap and easy to file such a suit, have it obviously thrown out and then rail about the unfairness of the govt. not even listening to your suit.

He's getting donations, selling books and driving traffic to his website without having to bear the expense of a REAL federal challenge. Laughing all the way to the bank probably.
Highlighted in bold... you do realize he filed in the FEDERAL court, right? What the court said was it needed to be in the APPEALS court... which is a bit weird since it was never in the FEDERAL court in the first place... The Appeals court could say that there was never a verdict on the matter and needed to go back to the federal court...

Me thinks some people fell asleep a lot during government class. GuyNTexas did a wonderful job of explaining the situation.

U.S. District Judge Susan Richard Nelson apparently doesn't fully understand her duties
