Why do you think you would have the right to complain about either activity?

But i don't see why any proprietor can't have smoking in his own place. It's his loss if folks simply can't stand the smoke.

They had smoking and non smoking sections and it seemed to work very well. I am a non smoker and I don't want to go to a place where I can't enjoy a meal because of cigarette smoke.

They are in the realm of you having no argument against them because I'm comparing apples to apples hence the reason you have attacked the question itself instead of the argument.

Such a setup really depends on how well it was conceived and built and other factors. If you have a small place it might not be possible at all. With adequate space and done correctly the non smoker should never be inconvenienced.

Why would you choose to be "trapped in any closed space with someone who is smoking a cigarette?"

Considering that just about everything else in America was better during the times before smoking bans, I would say that a little second hand smoke is a small price to pay for a much better country overall

Unfortunately, this is not true. The state can tell you what to do anywhere. We have allowed the government to become so powerful that telling us how to live has become normal. Many people think it is normal for government to tell us what we can sell, buy, eat, drink and smoke and to require a license to do what it allows us to do.
