People who hate the Government are just power hungry. They want to be the ones in control. Freedom means nothing. Case in point, the areas were Government is hated most fully supported slavery.
If you pick a stupid fight with the government (meaning not knowing or caring about the law, and how it really works) you're going to lose. You can spout all you want, that won't change a thing.
Let's take this out of the usual anti-government nut realm. Or, to put it another way, let's assume what these guys assume: that the only obligations anyone has are obligations they have freely agreed to.
In this case, the guy freely agreed to all the contractual obligations of the mortgage, including its enforcement mechanism. Now he's just trying to avoid the consequences of his failure to carry out his obligations.
The " restrictive endorsement" on a check that did not clear due to insufficient funds is priceless.

Since this case took place in Oklahoma I will believe that you are talking about slavery in the state of Oklahoma. Right?
