She ran off with his money, it wasnt a case of her taking his $150, then saying something along the lines of "would you like anal for an extra $50"?
That would be an upsell, in this instance the dead hooker was guilty of theft.
Sounds like you've had some experience negotiating these things.
The guy hired a dancer, and thought he hired a hooker. "Hooking" costs extra. I was a cop for thirty years- I referreed a few of these misunderstandings. Sometimes the hooker gave the money back, sometimes the customer was poorer but wiser. But in CA, we don't allow the customers to shoot the hookers when things go south. We're funny that way.
"Guilty of theft..." Must have missed the trial. When was the hooker found "guilty of theft" in a court of law? I got a feeling the hooker had her side of the story to tell, that might have mitigated things somewhat. Her "driver" is also her bodyguard. Maybe Bubba scared her, so she tried to run to him for help. Looks like she had reason to be scared.
But, we'll never get to hear HER side, will we?
And since when is "theft" a capital offense, anyway? What are you, Muslims?
I haven't been to Texas in a while, but I have fond memories of a beautiful state full of friendly, common-sensible folks.

When did you guys go nuts?
It isnt hard to imagine the few upsell opportunities hookers have at their disposal.
Using lethal force to stop theft should be legal in all states, and I'm sure it would result in some lower crime rates as well.
That would leave you cops more time to act as revenue agents for your corrupt jurisdictions. Think of all the tickets you could write in the time it takes you to write up a few reports about theft.

In order to find the man not guilty the jury had to conclude the gal was guilty of theft. She should have let the man have his money and there would have been no reason to be scared.
Somehow Texas has had this law for 40 years without any 8 year olds or lawn care people being killed or any descent into chaos.
