She may want to consider claiming the car "accelerated on its own," i.e., mistook the gas for the brake.

That's right. Frightened and in a panic mode, confused mom gets drive and reverse gears mixed up. Along with confusion of the brake and gas petals too. Not to mention which direction to flee in. Poor thing, it's not her fault the guy had multiple tire tracks on his body.
