There is no way you can prove Martin attempted to murder him....and I an 99.9% positive that Martin did not have any intention on doing so.
But NOT A SINGLE PERSON in this world can determine whether Zimmerman, at that very moment, feared for his life or not. If he was in fact getting pummeled....who is to say he WASN'T?
You can invoke Miranda at any time. His so not smart move was continuing to cooperate After they released him.
Right when she told him he didn't have to speak with her and could leave, she told him he hadn't been arrested yet. That one word right there would be enough to ask for a lawyer.
Oh - just heard he said Martin said 'homey'? That seems off to me.
Emotions can be acted...and acting has no place in justice. And the perception of peoples emotions should have no bearing on these determinations.
Maybe it "should not" however it absolutely DOES. You cannot force people to testify without emotion. Btw, people can lie in a very rational and logical manner with no emotions at all. I can tell you from experience in courtrooms during trials, that very, very, very few people are good enough actors that they can be convincing "acting" regarding emotions. Best example I can think of this "bad acting" is the Jodi Arius trial. Her "crying" did not come across as genuine to the media watching her nor the jurors or other courtroom observers because Jodi was the typical non-professional actor witness, which is what you see in real world trials.
Based on witness testimony before this point, seems Zimmerman is embellishing a bit. Just a few extra words here and there. Other than that, seems to match up fairly well thus far. I am sure once it gets dissected, there will be plenty of nitpicking that doesn't match up.
It was the inoperable flashlight that shone on the body of evidence repositioned..
